These General Terms and Conditions (hereinafter - the “Terms”) are specific when using our website and shopping with Us online.
These Terms constitute a legally binding agreement between Customer and Upp Wellbeing Ltd (company number: 12860248 , with its registered office at Beechwood, Park Drive, Doncaster, DN5 7LP) governing Your use of the Online - store BigBrightLight.com. Online-store’s website bigbrightlight.com (the “Website”), and related services, information and communications are collectively referred to as the “Online store”, “We”, “Us” or “Ours”.
The use of all personal data You submit to the Online-store or which we collect about You is governed by our Privacy Policy (“Privacy Policy”). A copy of our Privacy Policy is available at bigbrightlight.com/privacypolicy. You acknowledge that by using the Online store You have reviewed the Privacy Policy.
For the purposes of these Terms, we define the term “Customer”, “You” or “Your” as an individual or business entity, who uses the Website to order or view any product(s) in our Online store.
We may modify the Terms from time to time to reflect changes in market conditions affecting our business, changes in payment methods, changes in relevant laws and regulatory requirements and changes in our system. If we do so we will notify You by email to the email address You have provided Us with, however we are not obliged to, and such modification shall be effective upon our posting of the revised Terms on the Website. You agree to be bound by any changes to these Terms when You use our Website and Services after any such modification is posted on the Website. It is therefore important that You review the Terms regularly to ensure You are updated as to any changes.

1. Information on our website
1.1
We try our best to make sure that all information on our website, including descriptions of our products and listed prices, are accurate at all times. However, if we do make a mistake we’ll try to resolve it as soon as possible, and if we spot that an error has affected Your order we’ll do our best to let You know.
1.2
When browsing our website the colors of products may vary depending on a few factors in Your display settings.
1.3
Pictures and images on our website are for illustration purposes only. For an accurate description of any product and details of what is included with the product, please read the product description.
1.4
We will do our best to check our website for viruses but we do not warrant that the website is free of viruses or other malicious content.
2. Product availability
2.1
All products are subject to availability and so we may not be able to supply Your order. In unforeseen circumstances and with or without notice we may have to stop selling products through our Online store either temporarily or permanently.
2.2
We will not be liable for any losses You sustain as a result of updating or modifying our website.
2.3
The site also offers a subscription service. The subscription service means that  You will receive orders on a regular basis. You can, at Your discretion, select and change the product(s) in and the regularity of the order within the parameters of the subscription service.
3. Security
3.1
The right to order products. By shopping online, You represent and warrant that You are 18 years of age or older. You will need a valid email address and telephone number so that we can easily contact You.
4. Placing your order and cancellations
4.1
Your order counts as an offer to purchase product(s) from us.
4.2
After placing Your order, You will receive an order confirmation email. This contains details of the products You have ordered, the total cost of the order and an order number. 
4.3
To cancel or amend Your order please forward Your confirmation email to support@uppwellbeing.com as soon as possible.  We cannot guarantee cancellations or amendments to orders. It just depends if the order has been processed by the time You let Us know.  We will however do our best to accommodate You.
5. Order Acceptance
5.1
Acceptance of Your order will take place when we dispatch the product(s) to You. Until we dispatch the product(s), no contract will have been formed between us.
5.2
Although we hope to be able to supply all products ordered, we reserve the right, at our discretion and without the need to give reasons, not to accept any offer at any time. If we refuse Your order we will let You know as soon as reasonably possible.
6. Payment
6.1
We will take payment from Your card at the time You place Your order. Taking payment does not mean we have accepted Your order and if for any reason we are unable to accept Your order we will provide You with a full refund within 14 days.
6.2
Customers may pay for the order using payment methods such as the following: VISA, MasterCard, Maestro, Shop Pay, Google Pay, Apple Pay or any methods which the card payment processors will accept.
7. Pricing
7.1
Unless otherwise stated all prices shown at our Online store are inclusive of VAT and other applicable taxes. The product prices shown do not include the shipping fee, which will be added to Your total order price. UK shipping is free. Shipping outside the UK will incur additional charges if applicable.
8. Pricing errors
8.1
If we discover an error in our pricing we will inform You as soon as possible and You will then be given the option of cancelling or re-confirming Your order at the correct price.
8.2
If for any reason we are unable to contact You using the contact details You have provided the order will be cancelled and You will be notified by the email You provided.
8.3
Any cancelled orders will be refunded within 14 days of the cancellation.                      
9. Shipping
9.1
If the product(s) is in stock and ready to ship, it will be shipped on the day of order if the order was placed before 2:00 pm (GMT) Monday through Friday.
9.2
Shipping time within the UK is 1 working day. Shipping time  outside the UK depends on the carrier selected. On average, shipping time within the EU (2-3 days) and around the world (2-7 days). We will try our best to meet the shipping date, however, there may be times where we are unable to do this and Your confirmed shipping date will be different.
9.3
The shipping method is chosen by UPP Wellbeing based on reliability and price and is not one specific carrier.
9.4
Changing the date of shipping. If You would like to change Your shipping time or date, please forward Your order confirmation email to the Customer Support Centre support@uppwellbeing.com  and they will advise if this is possible.
9.5
In the event of any unforeseen circumstances (such as traffic accidents, major traffic delays, or severe weather) we will do our best to contact You to rearrange an alternative shipping timeslot or date. We will not be responsible for any losses (including loss of revenue, profits, anticipated savings, goodwill, or business opportunity, for any injury to Your reputation) incurred due to a delay in shipping arising out of any cause beyond our control.
9.6
When You arrange Your shipping, we will ask You to provide certain information. This information will be recorded on the shipping document and the shipping will take place at the shipping address You specify. If You provide Us with incomplete, incorrect or inaccurate information or instructions, we may cancel the shipping by giving You written notice using the email provided when the order was placed.
9.7
You are responsible for ensuring that You are available to accept shipping. If You are not, there must be an adult available who is capable of receiving shipping on Your behalf, and You agree that we can rely on their instructions as if they were Your own.
9.8
Do not accept shipping if there are any signs of damage to the box. Once the package has been accepted You take full responsibility for any damage that may be later reported.
10. Returns
10.1
You can return new and unused product(s) within 30 days of making Your purchase, subject to the limitations set out in these Terms.
10.2
We will provide a refund for the product(s) returned with the original proof of purchase, in a new and unused condition, and with the original packaging, which has the silver product label and batch number totally intact. You are responsible for any costs incurred in returning the product(s). We will refund the price paid for the product(s) via the original payment method only after we make sure that the product(s) are intact and unused.
10.3
A refund may be refused, or the value of the refund reduced if the product(s) are not able to be sold at full retail value as a result of You handling the product(s) in such a way that the product(s) are no longer saleable at full retail value. We at its sole discretion may reduce Your refund to reflect any reduction in the retail value of the product(s). Any refund and reduction will be proportionate to the retail value of the product(s) in the condition returned.
10.4
There are certain circumstances, where at our sole discretion we are not able to accept returns, cancel orders or offer a refund unless the product(s) is faulty (or unless there is any other breach of Your statutory rights). These exclusions are as follows:
  • where You do not have proof of purchase;
  • where the product(s) are returned without full packaging;
  • where the product(s) are not returned in a saleable condition.
10.5
We also cannot exchange or refund for faulty product(s) if You have not registered Your product and received a warranty email via website within 2 weeks of receiving Your order at bigbrightlight.com/register.

11. Product Review
11.1
Please note that by submitting a review to our website You will be deemed to have accepted these Terms.
11.2
We display both positive and negative reviews but all content is moderated to ensure it is appropriate for publication on our website. This means that after You submit Your review it will not immediately appear on our website. We reserve the right to accept or reject any product review submitted to Us and we may edit the length and/or content of any review as we see fit.
11.3
You agree that You will not submit any content:
  • That is false, inaccurate, misleading, defamatory, libellous, obscene, pornographic, indecent, lewd, suggestive, harassing, threatening, abusive, fraudulent or otherwise objectionable;
  • That infringes any third party’s copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy;
  • For which You were compensated or granted any consideration by any third party;
  • That violates any local, national or international law;
  • That references other companies or websites;
  • That contains any computer viruses, worms or other potentially damaging computer programmes or files;
  • That includes the personal information of any third party.
  • That includes unsolicited promotions, mass mailings or spamming, political campaigning, advertising or solicitations;
Once Your review has been submitted You will not be able to edit it. If You would like to have Your review removed from our website, please contact Us at support@uppwellbeing.com.
11.4
We are currently unable to publish reviews that are not written in English.
11.5
Please do not include any personal information such as Your name, contact details or email address. We will remove these before posting.
11.6
In order to comply with the law, to protect our systems and customers, and to ensure the integrity and operation of our business and systems, we may access and disclose any information we consider to be necessary or appropriate, including, without limitation, user profile information, IP address and posted reviews. Please refer to our Privacy policy for further information.
11.7
Please note By submitting a review You grant Us a non-exclusive, royalty-free, perpetual, irrevocable, transferable and fully sub-licensable right to use, reproduce, modify, adapt, translate, distribute, publish, create derivative works from and publicly display such review throughout the world in any media without compensation to You. You acknowledge that we may choose to provide attribution of Your comment or review at our discretion.that by submitting a review to our website You will be deemed to have accepted these Terms.
11.8
Although we will do our best to moderate all reviews posted, we assume no liability for any reviews posted, stored or uploaded by You or any third party. We will not be held liable for any loss incurred by You as a result of a review published on our website.
12. Our liability
12.1
Our entire liability to You under these Terms shall not exceed the price paid for the product(s) You have purchased through our online shop.
12.2
We will not be liable to You for any loss of revenue, profits, anticipated savings, goodwill or business opportunity, for any injury to Your reputation or for any losses that are not reasonably foreseeable by both of Us at the time Your purchase is made or Your order is accepted.
12.3
Where You buy as a consumer, these Terms will not affect Your rights under law which cannot be otherwise excluded.

Our privacy policy (together with our Terms) sets out why we collect data from You and how it will be processed by Us. Please read the Privacy policy available on our website, carefully so that You understand our views and practices and how we will treat Your data.
13. Trademark
13.1
"Upp" is a registered Trademark in the UK and Europe. Except to the extent expressly permitted by applicable law, no Trademark may be used, copied, modified, translated, distributed or otherwise utilised without the prior written permission of the owner of the Trademark.
14. Disputes and governing law
14.1
In the event You have a complaint regarding a product or service purchased from Us, please contact at support@uppwellbeing.com.
14.2
In the event of a dispute, claims can be resolved by evaluating the product(s) using the analysis of the image(s) or video(s) that You provide.
14.3
If the image(s) and video(s) are not enough for evaluating the product(s), and in the investigation and resolving disputes, You can send the product(s) so that the Upp Wellbeing team will evaluate the defect of the product(s) and make a decision on the dispute.
14.4
If You are a consumer, please note that these Terms, their subject matter and formation, are governed by English law. You and We both agree that the courts of England and Wales will have non-exclusive jurisdiction.
14.5
If You are a business, these Terms, their subject matter and their formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.
